Chapter 13 - Chapter 13 is a federal law designed to help individuals, married people and single-owner businesses repay their debts with dignity and peace of mind.
For the unincorporated business, it is a reorganization similar to that available to larger companies in Chapter 11.
Since Chapter 13 is a rehabilitation, Chapter 13 usually stops collection efforts, many creditors' charges, repossessions, and foreclosures.
Chapter 7 - Chapter 7 is a federal bankruptcy law enacted by Congress to give individuals, married couples, or businesses in financial difficulty a fresh start.
Chapter 7 is known as "straight bankruptcy." It allows individual debtors to discharge (and not pay) most debts, keep many or most assets, and then start over.
In exchange, the debtor surrenders any non-exempt assets to be liquidated for the benefit of creditors.
For corporations, all assets are liquidated with the process providing for the orderly winding up of the business.
